General Terms of Use for the registros.com Website

These Terms and Conditions (hereinafter, the “Agreement”) constitute an agreement between Dinamon LLC, a Delaware (USA) company and owner of the Registros.com website (hereinafter “Registros.com,” “we,” or “us”), and the customer (hereinafter, the “Customer”). This Agreement sets forth the conditions for both visitors to our website and customers who purchase products and/or services through Registros.com.

This Agreement takes effect as soon as you visit our website or purchase any product or service from Registros.com. By accessing or using our website—and by contracting any services offered through Registros.com—you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement and by any additional policies or agreements explicitly referenced herein (collectively, the “Policies and Agreements”). These Policies and Agreements are linked on our site and include, among others, our Privacy Policy, Acceptable Use Policy, Domain Registration Agreement, and any other applicable documents.

This Agreement outlines our obligations as a service provider to you (the Customer) and your obligations to Registros.com regarding the purchase and use of our Services. These obligations are additive—that is, they supplement rather than replace—any specific agreements or terms that apply to each individual Service.

This Agreement has been drafted in both Spanish and English. In the event of any discrepancies or divergent interpretations between the two versions, the English version shall prevail.

1. Introduction

1.1 Definitions

  • Registros.com, “we,” “us,” “our,” or “ours”: Refers to Dinamon LLC, a Delaware (USA) company and owner of the Registros.com website.
  • Customer: Refers to any individual, company, organization, or agent who contracts for or uses the Products and Services offered through Registros.com, as well as any agent, employee, or person authorized to act on their behalf.
  • Account, User Account, or Customer Account: Refers to the online account the Customer creates and uses to access and manage products and services on Registros.com, including making payments and retrieving invoices related to the contracted Services.
  • Product(s) and Service(s): Refers to all products and services offered through Registros.com, including but not limited to domain registration, web hosting, SSL certificates, email services, and other related services.
  • Domain Registrations: Refers to the services provided by Registros.com for registering and managing internet domain names on the Customer’s behalf. These services include checking the availability of a domain name, submitting the registration request, managing DNS settings, and other tasks associated with domain name administration.
  • Hosting, Webhosting, Web Hosting: This term refers to the services offered by Registros.com to host websites on servers provided by the company. This includes the storage of files, databases and other resources necessary for websites to be accessible online. Hosting services may also include the management of email accounts related to the hosted domain and the provision of resources such as bandwidth and storage capacity.
  • Reasonable Suspicion: Exists when Registros.com possesses objective, documented, and verifiable evidence indicating that the Customer may be engaging in activities that are fraudulent, unlawful, or contrary to these Terms and Conditions. Such evidence may include, but is not limited to, third-party reports, records of unusual transactions, or proof of fraudulent use of payment methods.
  • Reasonable Grounds:Arises where, in the judgment of a prudent and objective person, circumstances justify taking specific measures (e.g., suspending or canceling an account). These circumstances may include, but are not limited to, presenting false, inaccurate, or incomplete information; failing to respond to a verification request; or fraudulently using Registros.com’s Services.
  • TLD (Top-Level Domain), domain extension, or extensions: The final portion of a domain name, such as “.com,” “.org,” or “.net.” Each TLD is regulated by a designated authority that establishes policies and requirements for assigning domain names under that TLD.
  • Registry (domain): Refers to the entity responsible for managing and maintaining a centralized database of domain names for a specific TLD (e.g., .com, .org, .net, .us, .uk, .es). The Registry administers and controls the assignment of domain names within its respective TLD and sets the policies and regulations governing those domain names.

1.2 Acceptance of the Terms and Conditions

a. By simply using the Registros.com website or by contracting and/or using any Product and/or Service offered through Registros.com, the Customer agrees to comply with all the Terms and Conditions set forth in this Agreement, as well as any referenced Policies and/or any specific Agreements pertaining to the relevant Products and Services. This Agreement constitutes a binding contract between the Customer and Registros.com and takes effect from the moment the Customer first accesses or uses the Registros.com website, or from the date they purchase any Product and/or Service offered through Registros.com, whichever occurs first.

2. Additional Policies

a. The following Policies and Agreements are incorporated into this Agreement by reference and form an integral part of it:

  • Privacy Policy: This policy governs the collection, use, and disclosure of personal data by Registros.com. It is available at: https://www.registros.com/en/privacy-policy/
  • Domain Registration Agreement: This agreement sets forth the specific terms and conditions applicable to the registration and management of domain names through Registros.com. The Customer must review and accept this agreement when registering a domain. It is available at: https://www.registros.com/en/domain-registration-agreement/
  • Acceptable Use Policy: This policy outlines the rules and guidelines for the proper use of Registros.com’s Services, including restrictions and prohibitions related to resource usage and Customer conduct on the platform. It is available at: https://www.registros.com/acceptable-use-policy/

b. Additionally, any other Policies and Agreements referenced in this Agreement or in the documents mentioned in section 2(a) are incorporated by reference and shall be deemed an integral part of this Agreement, binding upon the Customer.

3. Use of the User Account

3.1 Customer Information

a. The Customer agrees to provide true, accurate, and complete information about their identity when registering as a user on Registros.com. The Customer also agrees to periodically review the information provided and guarantees the accuracy and validity of the data associated with their Account, as well as any Products and Services contracted. If Registros.com has reasonable grounds to suspect that the provided information is false, inaccurate, outdated, or incomplete, Registros.com reserves the right to suspend or terminate the Customer’s Account and prohibit any current or future access to the Products and Services.

b. The Customer expressly declares that they are at least 18 years old. Registration as a Customer, as well as the contracting and use of our Services, is strictly prohibited for individuals under 18 years of age.

3.2 Verification and Updating of Information

a. Registros.com reserves the right to request verification and/or updates to the information provided by the Customer, who must provide a complete and accurate response to Registros.com’s request within a maximum of 5 business days. The Customer understands and agrees that failure to comply with this requirement constitutes a breach of this Agreement and may result in the suspension or termination of the contracted Products and Services and/or the cancellation of the Customer’s Account.

3.3 Use of Multiple Accounts and Identity Fraud

a. The Customer agrees to use a single account to access Registros.com’s services. Creating duplicate accounts, impersonating a third party, creating false identities, or engaging in any other fraudulent use of an account is strictly prohibited and may result in the immediate cancellation of all the Customer’s accounts, as well as potential legal action in cases of fraud or other serious misconduct.

b. A duplicate Account shall be understood as the creation of more than one account on Registros.com by the same Customer using different email addresses, usernames, or other identifying information. Any account created using a third party’s information without their consent is also considered a duplicate account. Creating duplicate accounts to obtain undue benefits, engage in fraudulent activities, or circumvent restrictions or sanctions previously imposed on an account is strictly prohibited.

3.4 Account Cancellation and Deletion

a. Registros.com reserves the right to temporarily suspend and/or permanently delete the Customer’s Account, along with all associated data and information (including, but not limited to, user messages, files, contacts, images, and other content) in the following cases:

  • Violation of any of the Terms and Conditions set forth in this Agreement.
  • Receipt of a court order or a directive from a competent governmental authority requiring the cancellation or suspension of the Account.
  • Use of the Account in a manner that is fraudulent, abusive, or otherwise unlawful.

b. Cancellation Procedure:

  1. Prior Notice: Registros.com will notify the Customer at least 5 business days in advance of the intent to cancel or suspend their Account, except in cases involving fraud, illegal activities, or security threats, where immediate action may be taken without prior notice. The notice will include the reason for the cancellation and the actions the Customer may take to prevent it.
  2. Opportunity to Respond: The Customer will have the opportunity to address and correct any violation or issue identified by Registros.com before the Account is canceled.
  3. Appeal Process: If the Customer disagrees with the decision to cancel or suspend their Account, they have the right to submit an appeal to Registros.com within 10 business days following the cancellation notice. However, appeals will not be considered in cases involving fraud, illegal activities, or security threats.

c. Immediate Cancellation Without Prior Notice: Notwithstanding section 3.4(b), Registros.com may, at its sole discretion, immediately cancel or suspend the Customer’s Account and/or any contracted Services without prior notice under the following circumstances:

  • When there is reasonable suspicion that the Customer is using Registros.com’s Services to engage in fraudulent activities, including but not limited to phishing, malware distribution, or spam.
  • When there is reasonable suspicion that the Customer is using Registros.com’s Services to infringe trademarks, trade names, or any other intellectual property rights of a third party.
  • If payment for Registros.com’s Services is made using fraudulent methods, including but not limited to stolen credit cards, or when there is reasonable suspicion that fraudulent payment methods have been used to purchase Registros.com’s Services.
  • If the Customer’s use of Registros.com’s Services could create legal liabilities or negatively impact the performance of Registros.com’s technical systems, providers, partners, or affiliates.

d. No Refunds and Reporting to Authorities: In the cases outlined in section 3.4(c), Registros.com reserves the right to take immediate action to protect its interests, as well as those of its Customers, Employees, Partners, Providers, and/or Agents, or to comply with its legal or regulatory obligations. The Customer shall not be entitled to any refund or reimbursement for any amounts paid, regardless of the remaining service period. Additionally, the Customer shall have no right to appeal the decision. Registros.com also reserves the right to report any fraudulent or illegal activities conducted by the Customer to the appropriate authorities.

3.5 Customer Responsibility for Actions of Agents, Employees, or Authorized Persons

a. The Customer acknowledges and agrees that they are fully responsible for all actions taken by their agents, employees, or authorized persons, as well as for any consequences arising from such actions when using their Account or the Products and Services contracted through Registros.com. The Customer commits to ensuring that their agents, employees, or authorized persons use the Account and the Products and Services in compliance with the Terms and Conditions of this Agreement and all applicable laws. Any violation of the Terms and Conditions by the Customer’s agents, employees, or authorized persons shall be considered a violation by the Customer themselves and may result in the suspension or termination of the Account and any contracted Products and Services, at Registros.com’s sole discretion.

3.6 Prohibited Persons (Countries, Entities, and Individuals)

a. The U.S. Department of the Treasury, through the Office of Foreign Assets Control (“OFAC”), prohibits U.S. companies from conducting business or engaging in certain transactions with specific sanctioned countries, individuals, organizations, or entities, including but not limited to individuals classified as Specially Designated Nationals (“SDNs”) listed on the OFAC sanctions list.Users residing in sanctioned countries or designated as SDNs are strictly prohibited from using Registros.com Services.

3.7 Disputes Regarding Rights to the User Account

a. In the event of a partnership dissolution, divorce, or any other legal dispute that may affect the Customer, the Customer understands that Registros.com will remain neutral and will not take any action to favor or disadvantage any party involved until a final resolution is reached through a legally binding agreement or court order. Under no circumstances shall Registros.com be liable for any losses incurred by the Customer during this period.The Customer agrees to defend, indemnify, and hold Registros.com harmless from any claims arising from such disputes, with legal representation of Registros.com’s choosing, at the Customer’s expense.

4. Ordering and Use of Products and Services

a. Registros.com acts solely as a reseller of various services provided by third parties (hereinafter, the “Providers”) and does not own, manage, or control these services. The Customer acknowledges and agrees that by purchasing Services through Registros.com, they are subject not only to Registros.com’s Terms and Conditions but also to the applicable terms and conditions of the corresponding Providers.These Provider terms and conditions may include restrictions, limitations, and additional requirements that could affect the availability and functionality of the contracted Services. The Customer agrees to comply with these Provider terms and conditions, and acknowledges that failure to do so may not only result in the suspension or cancellation of the Services but may also lead to additional consequences imposed by the Provider. The list of Providers and links to their terms and conditions will be provided in a specific section of this Agreement.

4.1 4.1 Service Ordering and Activation Process

a. The Customer may request the desired Service by selecting the relevant domain and/or plan and completing the corresponding payment. However, payment alone does not constitute acceptance of the order or guarantee the provisioning of the Service, which remains subject to compliance with the conditions set forth in this Agreement, as well as any applicable regulations or legal requirements.

b. Once the order has been approved by Registros.com, the Customer will receive the necessary information to manage the Service. Additionally, the Customer will be able to access the Service through their User Account. For domain names and SSL certificates, activation will take place once it has been approved by the relevant authority (Registry or Certification Authority).

c. The Customer understands and agrees that the contracted Services may take up to 48 hours to become fully active due to the propagation of DNS information associated with the domain. Additionally, the Customer acknowledges that activation times for certain domain extensions (such as .ar, .br, .pa, etc.) may be longer due to the processing procedures of the corresponding Provider and/or Registry.

d. For Web Hosting and Business Email services linked to a domain registered with another provider, Registros.com will provide the necessary DNS information to connect the domain to the contracted Service. In such cases, the Customer is solely responsible for configuring their domain correctly in accordance with the information provided by Registros.com. Failure to do so may affect the functionality of the Service, for which Registros.com shall bear no responsibility.

e. By acquiring the Service, the Customer represents and warrants that they have the necessary administrative rights and/or ownership of the domain. Registros.com may request proof of such rights at its discretion.

4.2 Description of Products and Services

4.2.1 Domain Registration

Registros.com provides domain registration, transfer, and renewal services. Below are the key features and conditions of this Service. The Customer can access the full terms of the Domain Registration Service in the Domain Registration Agreement.

a. Availability Check: Customers can check the availability of a domain using the search forms on our website. If a domain appears as available, the Customer may proceed with the registration request.

b. Registration Request: Registros.com will submit the registration request to the corresponding Registry and/or Provider only after receiving full payment for this Service. However, payment does not guarantee successful domain registration.If the domain is found to be unavailable for registration due to a technical error or any other reason, Registros.com will contact the Customer and issue a refund in accordance with section 4.5 (“Refunds”). Some of the reasons that may prevent the successful registration of a domain include, but are not limited to:

  • The domain becomes unavailable between the time of payment and the processing of the request (e.g., due to simultaneous or consecutive requests processed by another company).
  • The Customer does not meet the specific requirements established by the corresponding Registry.
  • Connection issues with WHOIS databases or the Registry’s database, and/or incorrect information provided by the domain availability service used by Registros.com.
  • A domain that is already registered is erroneously displayed as available due to a technical issue of any kind.

c. Management of Registered Domains: Once the registration has been approved and processed, Customers can manage their domain through their account on Registros.com. The Customer understands that once a domain registration request has been approved, no refunds can be requested, as registration fees and processing costs have already been incurred.

d. Duration and Renewal: The domain registration will be valid for the period specified during the registration process. During this time, the Customer may extend the registration period at any time before the due date (also referred to as the "Renewal Date") through their User Account.If the Registry imposes renewal limitations for the requested period, Registros.com will renew the domain in successive increments as permitted by the Registry until the total contracted renewal term is fulfilled.

The Customer understands that for certain domain extensions (e.g., .ar, .br, etc.), the Renewal Date may be earlier than the expiration date. Additionally, the Customer acknowledges that the time between the Renewal Date and the expiration date is intended to ensure the proper processing of the domain renewal within the registration period. Consequently, Registros.com does not guarantee the renewal of a domain once the Renewal Date has passed.If the Customer requests a domain renewal after the Renewal Date has passed, Registros.com will inform them whether the domain can be recovered through a special recovery process (hereinafter "Recovery Process" or "Restore") and will communicate the applicable conditions of this process.

e. Domain Expiration: Once the Renewal Date has passed, Registros.com makes no guarantees regarding the renewal or reassignment of an expired domain, and the Customer assumes full responsibility for timely renewal.For some domain extensions, a Grace Period and/or Redemption Period may exist after a domain has expired. In certain cases, it may be possible to recover a domain in these periods through a Restore process.The availability of this option will depend on the policies set by the relevant Registry, as well as the conditions established by our Providers. If the Customer wishes to renew a domain after the Renewal Date has passed and recovery is possible, Registros.com will communicate the applicable conditions for the Restore.

4.2.2 Web Hosting

a. Registros.com offers Web Hosting services (hereinafter referred to as “Hosting,” “Web Hosting,” “Webhosting,” or “Alojamiento Web”) through various plans with different features tailored to the Customer’s needs. The specific details and conditions of each plan can be found at: https://www.registros.com/en/hosting.

4.2.2.1 Support and Satisfaction Guarantee de Satisfacción

a. Registros.com is committed to maintaining high service standards for its customers. In the event of an issue, the Customer may contact the support team through their user account at Registros.com. Registros.com will respond within a maximum of 48 hours, depending on the nature of the issue.

b. Registros.com offers a 180-day satisfaction guarantee from the date of purchase of the Hosting service. During this period, the Customer may request the cancellation of the Service and a full refund of the amount paid, without needing to provide a reason for cancellation.If the Hosting plan includes a promotional free domain registration, the refund for the Hosting service will be issued after deducting the standard domain registration fee applicable at the time of purchase, as specified in the “Domain Price List” section. After 180 days from the initial purchase date, the Customer will no longer be eligible for a refund.

4.2.2.2 Features of the Web Hosting Service

a. Registros.com will allocate to the Customer’s Hosting account the resources corresponding to the selected plan. The monthly bandwidth assigned to the Service will not roll over to the next billing period.

b. If the Customer exceeds their assigned bandwidth limit, Registros.com may, at its sole discretion, suspend the Customer’s account until the next billing period or offer the option to purchase additional bandwidth through an account upgrade.

c. All Web Hosting plans include Email Hosting services, which allow the Customer to create and delete email accounts, manage passwords, set mailbox storage quotas, and configure other server-specific settings.

d. Email Storage Limitations: To help manage storage limits, Registros.com reserves the right to automatically delete all messages in the Trash or Deleted Items folder that are older than thirty (30) days. Similarly, Registros.com may also delete messages in the Spam or Junk Mail folder that are older than thirty (30) days to assist with storage management.

e. Email Delivery Disclaimer: Registros.com provides email services on an “as-is” and “as-available” basis and does not guarantee the successful delivery of incoming or outgoing emails. The Customer acknowledges that multiple external factors beyond Registros.com’s control may impact email deliverability. These factors include, but are not limited to: spam filters, network availability, blacklists, and specific policies of recipient or sender mail servers. The Customer is responsible for taking the necessary measures to ensure that emails sent through Registros.com’s servers comply with proper sending policies and do not get classified as spam (“SPAM”).

4.2.2.3 Acceptable Use of the Web Hosting Service

a. Illegal or fraudulent activities are strictly prohibited, including but not limited to phishing, spamming, hosting and/or distributing malware, or any activity that may cause harm to Registros.com, its employees, providers, partners, or Customers.

b. The use of the service to promote violence, hatred, discrimination, or any activity that infringes upon human dignity and honor is strictly prohibited.

c. The sending of bulk or unsolicited emails (SPAM) is not allowed. Any email campaign sent to more than 200 recipients will be considered SPAM and may result in the suspension of email services. Email services may also be suspended for messages sent to fewer than 200 recipients if our systems detect that the emails are unsolicited, categorized as SPAM, result in user complaints, or pose a risk to our network reputation.

d. The unlimited features of hosting plans are intended for website hosting and email accounts. Customers are expected to use these resources responsibly, in compliance with this Agreement, the Acceptable Use Policy, and any other applicable Agreements, avoiding activities that may degrade service performance and/or compromise the security and stability of the services provided by Registros.com.

e. The Customer acknowledges and agrees that Registros.com may, at its sole discretion, remove from its servers any material, content, or software that is unauthorized or that may compromise the Services.

f. When using Registros.com’s Web Hosting Services, the Customer agrees not to impose an excessive or disproportionate load on CPU resources, servers, or associated infrastructure, including customer support services. Registros.com reserves the right to take corrective action, including temporary suspension or service termination, in the event of excessive resource usage. Examples of activities that generate excessive load include, but are not limited to:

  • Excessive server resource consumption: Running a website with high traffic volumes and/or poorly optimized scripts that consume a large amount of server resources, such as CPU and memory. (e.g., a website with inefficient scripts consuming excessive resources).
  • DDoS attacks: Attempting to launch a Distributed Denial-of-Service (DDoS) attack from a hosting server can place an extreme load on the server and negatively affect other users.
  • Mass email sending: Sending large volumes of emails can consume significant resources and put the reputation of our network at risk.
  • Heavy database usage: Executing a high number of database queries within a short period of time.
  • Use of hosting resources for non-website-related activities: Storing or distributing large multimedia files that are not directly related to website hosting.
  • Malicious scripts or malware: The presence of malicious scripts or malware can lead to excessive resource usage, harm server security, and impact other users. This is strictly prohibited.

g. The Customer understands that bandwidth and similar capacity metrics are maximum thresholds. Sustained or repeated usage at these maximum thresholds may lead to service limitations, which Registros.com may impose at its sole discretion. These may include service suspension, cancellation, or bandwidth reduction without prior notice. The Customer agrees to such limitations should their usage exceed that of similarly situated Customers.

h. Web Hosting accounts may use a maximum of 600,000 inodes and 35 simultaneous HTTP connections to the server.

i. The Customer is responsible for downloading and deleting backups after their creation. Registros.com may, at its discretion, remove backup files stored on its servers to ensure efficient resource allocation.

4.2.2.4 Restrictions on Unlimited Features

a. Unlimited Data Transfer: This excludes streaming, file and image sharing, data and/or file storage and transmission unrelated to the website, chat channels, and illegal activities.

b. Unlimited Databases: Databases must not negatively impact server performance. A database exceeding 300 tables or 2GB in size may be subject to restrictions.

c. Unlimited Email Accounts: The use of this feature to resell or offer free email services is strictly prohibited. Email accounts may not be used for file sharing beyond reasonable email attachments (maximum 5MB per attachment). Any fraudulent or illegal activity—or activity that raises reasonable suspicion of fraud or illegality—is strictly prohibited.

The email service included in our Web Hosting plans may not be used for sending or storing emails with large attachments exceeding 5MB.

For hosting plans with unlimited disk space, the maximum allocated disk space per email account is 2GB.

d. Unlimited Disk Space: Hosting plans offering unlimited disk space are strictly limited to website hosting and email storage. The Service does not permit the following uses:

  • Storage of private files and/or data unrelated to the website.
  • Storage of large files, including but not limited to images and image galleries.
  • Storage of backups.
  • File-sharing services and/or private FTP hosting.
  • Storage of multimedia content.

Registros.com reserves the right to suspend, cancel, or delete any Hosting Service that violates these conditions or compromises the quality, availability, stability, or security of its Services.

Additionally, Registros.com reserves the right to delete any material or file occupying space in the Customer’s account without prior notice, including but not limited to:(i) Any type of backup stored on the server. (ii) Error logs. (iii) Activity logs. (iv) Any other large file that is unnecessary for the operation of the Customer’s website or does not contain valuable information.

4.2.2.5 Backup Service Limitations

All Hosting plans provided by Registros.com include a backup service that allows account restoration in case of accidental deletion or system failure.

a. The Customer acknowledges that the backup service is provided as an additional and free feature. The Customer is solely responsible for maintaining backups of the data stored in their Hosting account. Registros.com assumes no liability for data loss or errors related to the use of the backup service.

b. Backup creation is limited by technical constraints (e.g., available storage space). Registros.com’s backup service is limited to a maximum aggregate storage size of 50GB per account. If a Hosting account exceeds 50GB of total disk usage, it will not be included in automated backups.

c. Registros.com disclaims all liability for user data loss in the event of a disaster or force majeure.

4.2.2.6 Storage of Expired Account Data

a. The Customer acknowledges that the validity of the Service is strictly limited to the contracted period stated on the corresponding invoice.

b. The Customer also understands that once the contract period has expired, or in the event of non-payment or service cancellation (whether by the Customer or by Registros.com under applicable terms), Registros.com has no obligation to maintain the Service active or retain any data stored by the Customer. Both non-payment and cancellation may result in the termination of the Service and the complete deletion of stored data.

c. If the Service expires, Registros.com will retain the associated Hosting account data for an additional 30-day period. During this period, the Customer may reactivate the Service by paying the outstanding invoice in full, after which their data will be restored. After this 30-day grace period, Registros.com will proceed with the permanent deletion of all data stored in the Hosting account.

d. If the Customer requests immediate service cancellation, or if the Service is canceled due to, but not limited to, payment reversal (chargeback), fraud, suspected fraud, or any violation of this Agreement, Registros.com reserves the right to permanently delete all data associated with the Hosting account within 24 hours of the cancellation request. This measure ensures the security and integrity of Registros.com’s Services.

e. The Customer understands that once the data associated with an expired or canceled Hosting account has been deleted, Registros.com will not retain any backups, and data recovery will be permanently and irrevocably impossible. Registros.com disclaims all liability for data loss in such cases.

4.2.3 SSL Certificates

Registros.com offers SSL certificate services to secure web connections and protect data transmitted between users and web servers. The specific details and conditions of each type of SSL certificate can be found at: https://www.registros.com/clients/store/certificados-ssl

4.2.2.1 Support and Satisfaction Guarantee

a. Registros.com provides technical support for the purchase and validation of SSL certificates. In case of any issues, the Customer may contact the support team through their User Account. Registros.com will respond within a maximum of 48 hours, depending on the nature of the issue.

b. Registros.com offers a 30-day refund guarantee from the date of purchase for SSL certificate services. During this period, the Customer may request service cancellation and a full refund, provided that the certificate has not been validated, issued, or activated. Once an SSL certificate has been validated, issued, or activated, refunds will not be possible.

4.2.3.2 Acceptable Use of SSL Certificate Services

a. The Customer must use the SSL certificate exclusively for the domain and purpose specified in the certificate request and validation process.

b. The Customer must not use the SSL certificate for fraudulent, deceptive, illegal, or unauthorized activities, including but not limited to impersonation, phishing, malware distribution, or other activities that compromise online security.

c. The Customer is responsible for maintaining the confidentiality of the private key associated with the SSL certificate and must not share it with unauthorized third parties.

d. The Customer must not use the SSL certificate for operations that exceed the limits specified for the purchased certificate type.

e. The Customer must not use the SSL certificate to authenticate, secure, or encrypt traffic for any domain or subdomain not explicitly listed in the certificate details.

f. Registros.com reserves the right to revoke any SSL certificate that violates the established conditions, is used in a manner that compromises security, or does not comply with the policies of the issuing Certificate Authority (CA).

g. Additionally, the Customer agrees to comply with all prohibitions, limitations, and conditions described in the Acceptable Use Policy.

4.2.4 Business Email Service

Registros.com offers a Business Email service with integrated cloud-based productivity tools, powered by OX App Suite. This Service includes advanced security measures, such as proactive spam filtering, virus scanning, and malware protection, ensuring a secure and efficient email experience.The specific details and conditions of each Business Email plan can be found at: https://www.registros.com/clients/store/email-profesional

4.2.4.1 Use and Limitations of the Business Email Service

a. The Customer acknowledges and agrees that Registros.com may define and update general practices and limitations regarding the use of the Service, including but not limited to:

  • The maximum retention period for email messages, documents, and other data stored through the Service.
  • The conditions for sending and receiving messages, including any restrictions on the number of emails sent and received.
  • The maximum allowed size for email messages and/or attachments that can be sent or received through the Service.

b. Registros.com assumes no liability for the loss of messages, files, or any other information received, transmitted, or stored through the Service, whether due to deletion by the Customer, system errors, or technical failures. The Customer bears sole responsibility for maintaining up-to-date backups of their messages, files, and any other stored data to prevent accidental loss.

c. Registros.com sets resource limits for each email account created through the Business Email Service (including but not limited to email storage and file storage) based on the subscription plan selected by the Customer.

  • If Registros.com, at its sole discretion, determines that a Customer’s use of the Service involves abuse or fraudulent activity (as defined in the Acceptable Use Policy), it may take corrective actions, including but not limited to:
    • Reducing storage or resource limits,
    • Restricting or suspending the ability to send/receive messages,
    • Temporarily or permanently suspending access to the Service.
  • Additionally, Registros.com may suspend or restrict the sending and/or receiving of messages, as well as the storage and/or retrieval of files through the Service, if there are reasonable suspicions of fraudulent or abusive use by the Customer.

4.2.4.2 Storage and Security

a. The Customer assumes full responsibility for maintaining the confidentiality and security of their Business Email account(s), including protecting against unauthorized access, misuse, or security breaches. This includes safeguarding their username, client ID, and password from unauthorized disclosure.

b. The Customer acknowledges and agrees that they are solely responsible for:

  • All actions, omissions, and usage related to their email account, including any access or activity by third parties, whether authorized or unauthorized.
  • Any content stored and/or transmitted through their Business Email account.
c. The Customer is solely responsible for implementing measures to:
  • (i) Prevent any loss or damage to their stored content.
  • (ii) Ensure the security, confidentiality, and integrity of email messages and files stored and/or transmitted through the Business Email Service, including implementing necessary safeguards to prevent unauthorized access, loss, or data corruption.
  • (iii) Maintain the confidentiality of their password and prevent unauthorized access to their account.

4.2.4.3 Content

a. The Customer acknowledges that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials (“Content”) that is published or transmitted, whether publicly or privately, by or to the Customer through the Business Email Service is the sole responsibility of the individual or entity that originated or transmitted such Content.

  • Accordingly, Registros.com bears no responsibility and shall not be liable for any Content that is transmitted, received, or stored through the Service, regardless of its nature.
  • The Customer understands that by using the Service, they may be exposed to offensive, indecent, or objectionable content.
  • Under no circumstances shall Registros.com be responsible for reviewing, moderating, or controlling any Content, nor shall it be liable for any direct or indirect consequences resulting from the use, transmission, or availability of such Content.
  • This includes, but is not limited to:
    • Errors or omissions in any Content.
    • Any loss or damage incurred as a result of using any Content that has been uploaded, emailed, transmitted, or made available through the Service.
Any valid complaint regarding inappropriate content will be handled in accordance with our Acceptable Use Policy.

b. Registros.com is not obligated to monitor, review, or control any Content stored or transmitted through the Business Email Service and assumes no responsibility for the accuracy, integrity, or quality of such Content.

4.2.4.4 Backups

a. The Business Email Service performs automated backups for all existing accounts. These backups are retained for 14 days and are stored exclusively for internal purposes and/or service restoration in the event of a technical failure.

  • Registros.com makes no guarantees, whether express or implied, regarding the integrity, completeness, or availability of these backups.
  • Backups are strictly for internal use, and the Customer acknowledges that they are not entitled to direct access or retrieval of these backups under any circumstances.
  • The Customer bears sole responsibility for maintaining local backups of their account content.

b. In the event of a service failure, Registros.com will attempt to restore lost data at no charge; however, data recovery is not guaranteed.

  • If data loss occurs due to Customer negligence—such as failure to maintain local backups, unauthorized modifications, or misconfigurations—Registros.com reserves the right to charge a data recovery fee.
  • The cost of data recovery will be communicated to the Customer before any recovery attempt is performed.

4.2.4.5 Storage of Expired Account Data

a. The Customer acknowledges that the validity of the Service is strictly limited to the contracted period stated on the corresponding invoice.

b. The Customer further understands that once the contract period has expired, or in the event of non-payment or service cancellation (whether initiated by the Customer or by Registros.com under the applicable terms), Registros.com has no obligation to maintain the Service active or to retain any data or information stored by the Customer through the Service.

c. Upon service expiration, Registros.com will retain the data associated with the Business Email account(s) for an additional 14-day grace period. Once this period has elapsed, all stored data will be permanently deleted and cannot be recovered under any circumstances.

d. If the Customer requests immediate service cancellation, or if the Service is canceled due to payment reversal (chargeback), fraud, suspected fraud, or any other violation of this Agreement, Registros.com reserves the right to permanently delete all associated data within 24 hours of the cancellation request.

e. The Customer understands that once the data associated with expired or canceled Business Email accounts has been deleted, Registros.com will not retain any backups and cannot recover the deleted data under any circumstances. The Customer bears sole responsibility for maintaining any necessary data backups before service expiration or cancellation.

4.3 Prices and Payments

a. The fees for Registros.com’s Services are published on the Registros.com Website or within the User Account. All Service fees will be charged according to the then-current fee schedule of Registros.com, which is incorporated into this Agreement by reference. Registros.com reserves the right to update fees at any time, and such updates shall be binding upon publication on the Registros.com website or within the User Account.

b. All fees and charges related to the renewal and/or purchase of a Registros.com Service will be displayed during the ordering process. By submitting an order, the Customer expressly agrees to pay the listed fees and charges, which will be processed immediately upon order submission. Registros.com will notify the Customer of successful payment receipt via a payment confirmation.

c. Registros.com exclusively accepts the following payment methods: Credit cards, Debit cards and PayPal.

d. The validity of the fees displayed during the ordering process does not apply to the renewal of domain names that have exceeded their Renewal Date. If the processing costs exceed the estimated renewal fees displayed during the order process, Registros.com will contact the Customer and offer the following options:

  • Pay the additional cost to proceed with the renewal.
  • Cancel the renewal request and receive a refund for the renewal fee paid.

e. The Customer understands that some domain names may be classified as "Premium" by the relevant Registry (e.g., .club, .casa). For such domains, the registration fee may be significantly higher than the standard registration, transfer, or renewal fees published by Registros.com. If a Customer requests a Premium domain, Registros.com will inform the Customer of the cost and request confirmation before processing the order. If the Customer does not confirm within the provided timeframe, the order may be subject to automatic cancellation at Registros.com’s discretion.

f. The Customer acknowledges that renewal fees for any Service purchased through Registros.com will be calculated based on the price applicable on the date the Customer submits the renewal request, regardless of the original amount paid at the time of purchase.

g. Registros.com reserves the right to modify its pricing at any time, without prior notice. For renewals of active Services, the Customer will be notified at least 14 days in advance. If the Customer does not cancel the Service before renewal, the updated pricing will apply.

h. The Customer understands and agrees that ordered Services will only be processed and activated once payment has been successfully received.

i. In the event of payment reversal, chargeback, fraud, or reasonable suspicion of fraud, Registros.com reserves the right to immediately terminate any and/or all Services purchased by the Customer and cancel the Customer’s User Account. The Customer remains fully liable for any unpaid fees and charges accrued before termination, and Registros.com reserves the right to pursue collection of such amounts.

j. If a payment reversal or chargeback occurs due to an error or oversight by the Customer, their bank, or their payment provider, Registros.com may, at its sole discretion, offer the possibility of restoring the Service upon payment of the outstanding balance plus an additional administrative fee.

k. All prices and fees are non-refundable, unless expressly stated otherwise in the specific terms of the purchased Service. Refunds will not be issued for partial use of Services, early termination, suspension due to non-compliance, or any voluntary or involuntary transfer of Services.

4.3.1 Currencies

a. All prices and fees for the Services offered by Registros.com shall be expressed in United States dollars (USD). Prices displayed in other currencies are based on an estimated exchange rate at the time of reference.

b. The Client understands and accepts that the pricing for the purchase and/or renewal of Services expressed in any currency other than USD may fluctuate due to variations in the respective currency’s exchange rate against the United States dollar (USD).

c. Registros.com reserves the right, at its sole discretion, to set prices in any of the permitted currencies independently of the prevailing exchange rate of that currency against the United States dollar (USD).

4.4 Renewals and Cancellations

4.4.1 Service Renewal

a. The initial term and validity of any Service purchased by the Client will be as specified during the ordering process and detailed in the invoice issued by Registros.com.

b. Unless the Client submits a cancellation request as outlined in the "Service Cancellation" section, the Service will automatically renew for the same duration as the previous term to prevent any unintended service interruption. To facilitate this, Registros.com will send a renewal invoice to the email address registered in the Client’s Account 30 days before the Service’s expiration date. 15 days before the expiration date, the applicable amount will be charged to the Client’s saved payment method. Registros.com reserves the right to attempt a second charge if the initial payment fails.

c. Automatic renewal does not apply to domain names for which the "Auto-Renew" option is disabled. In such cases, the Client will receive renewal notices in accordance with the "Domain Registration Agreement" and is responsible for manually renewing the domain before the Renewal Date. The Client may enable the "Auto-Renew" option at any time through the domain control panel in their Registros.com User Account.

d. The Client is responsible for keeping the payment methods associated with their Account up to date and ensuring their validity and availability of funds. The Client understands and agrees that Registros.com will process the renewal of Services only upon receipt of the corresponding payment.

e. Registros.com disclaims any liability for the deactivation and/or non-renewal of a Service due to the Client's failure to comply with the provisions set forth in this section or any other applicable terms in this Agreement or related agreements. The Client bears full responsibility for staying informed about Service renewal dates and making timely payments.

4.4.2 Service Cancellation

a. The Client may cancel their Services (excluding domain names) at any time by submitting a cancellation request through the "Request Cancellation" form available in the service control panel within their Registros.com User Account. Alternatively, the Client may request cancellation by submitting a ticket to Registros.com Customer Support through their User Account. Registros.com reserves the right to verify the Client’s identity before processing the cancellation request.

b. The Client may request cancellation either at the end of the current service term or immediately.

c. In the event of cancellation by the Client, the Client understands and agrees that the corresponding Service will be terminated, and all associated data will be permanently deleted within 24 hours after the cancellation request has been processed, except where applicable law requires Registros.com to retain certain data for a specified period (e.g., for fraud prevention, dispute resolution, or tax compliance in accordance with U.S. federal and Delaware state regulations).

d. For domain names contracted by the Client, cancellation must be requested by submitting a support ticket to Registros.com Customer Support through the Client’s User Account. Alternatively, the Client may ensure the Service is canceled at the end of the current contract term by confirming that the "Auto-Renew" option is disabled for the domain they wish to cancel. In such cases, any domain names for which the "Auto-Renew" option is not enabled will be automatically canceled on their Renewal Date and subsequently deleted in accordance with ICANN regulations and the applicable Registry’s policies, as set forth in the "Domain Registration Agreement".

e. Registros.com reserves the right to cancel any Client Service at any time in the event of non-payment, chargeback, payment reversal, fraud or suspected fraud, or any other violation of this Agreement or any associated Agreements and Terms.

f. Service cancellation does not entitle the Client to a refund unless otherwise specified in the specific terms of the Service.

g. If this Agreement is terminated due to the Client’s breach, the Client agrees to bear all costs incurred as a result of the termination, including any reasonable expenses incurred by Registros.com to close the Client’s Account and cancel their Services. These expenses may include but are not limited to administrative processing fees, unpaid service invoices, and applicable penalties as permitted under Delaware business law and international contractual law.

4.4.3 Abuse

a. The Client agrees not to use Registros.com Services for any purpose that conflicts with this Agreement, the policies of the relevant Providers, ICANN regulations, the applicable Registry policies, or any national or international legislation.

b. Registros.com may, at its sole discretion, and with prior notice where feasible, take any necessary and proportionate measures to safeguard and ensure the proper functioning and security of its systems and Services, as well as those of its Providers. This includes, but is not limited to, limiting, suspending, or canceling any Service or Client Account that engages in activities compromising the stability of Registros.com Services and systems, as well as those of its Providers. Such activities include, but are not limited to, excessive connections or requests to its systems and Services, inadequate security measures, violations of third-party intellectual property rights, mass email transmissions, the presence of malicious software of any kind (including viruses, trojans, and malware), or any other fraudulent activities such as phishing.

c. The purchase and/or use of Services to facilitate or engage in the following activities constitutes a violation of this Agreement and may result in the immediate suspension or cancellation of the Client’s Account, along with all associated Services:

  • Operating or distributing a botnet, participating in and/or facilitating phishing activities, or propagating viruses, malware, or similar threats.
  • Hosting or distributing illegal content or content for which there is reasonable suspicion of illegality, including references to such content.
  • Offering, selling, or promoting products and services that violate applicable laws and regulations, including but not limited to weapons and pharmaceutical products.
  • Willfully infringing the intellectual property rights of a third party, including but not limited to personal names, trade names, or trademarks.
  • Hosting, distributing, and/or publishing pornographic content of any kind.

d. The Client is responsible for monitoring the security of their Services. If their Service is compromised or used for abusive activities (whether knowingly or unknowingly), they must take immediate corrective action. Failure to do so may result in the suspension or termination of the affected Service(s).

e. Registros.com will forward to the Client any complaints it receives regarding the Products and/or Services contracted by the Client. The Client must respond to such complaints within a maximum period of five (5) business days via email, copying abuse[@]registros.com. Failure to respond within the specified timeframe may result in the temporary suspension or cancellation of the affected Service(s) without further notice. If there are reasonable grounds to believe the complaint is legitimate, Registros.com reserves the right to take any actions it deems appropriate to resolve the complaint. In cases where the Client disputes the complaint or believes the measures taken are unjustified, they may submit an appeal within ten (10) business days of the enforcement action. Appeals must be sent in writing to legal[@]registros.com, including supporting evidence.

f. Registros.com may charge the Client for administrative costs incurred in handling abuse-related issues, including, but not limited to, investigation fees, mitigation expenses, and external compliance audits. The Client agrees to bear any reasonable expenses arising from the review, processing, and resolution of abuse complaints related to their use of Registros.com Services.

4.5 Refunds

a. Registros.com offers a Satisfaction Guarantee period for some of its Services. During this period, the Client may cancel the Service and request a refund of the amount paid, provided the Service has not been used in a manner that indicates significant resource consumption, prolonged use, or excessive traffic. Registros.com reserves the right to deny refunds for Services that have been used extensively. The refund eligibility periods for different Services are as follows:

  • Domain registration, transfer, renewal, or recovery: Non-refundable.
  • Hosting Services: Refundable within 180 days from the initial purchase date.
  • Professional Email and SSL Certificates: Refundable within 30 days from the initial purchase date.

b. A refund request must be submitted separately from the service cancellation request by contacting Registros.com Customer Support. The Client may submit a request by opening a support ticket through their User Account or by sending an email to info[@]registros.com.

c. For Hosting Services that include a promotional free domain registration, the refund amount will be reduced by the cost of the domain registration as per the pricing listed in the "Domain Price List". After six (6) months from the initial purchase date, the Client forfeits any right to a refund.

d. Renewals of Hosting Services may be refundable at the sole discretion of Registros.com if the Client cancels the service and contacts Customer Support within forty-eight (48) hours of renewal. If a Hosting renewal is canceled within this timeframe, the Client may receive a full or prorated refund. However, if the renewal included a free domain registration, the standard cost of the domain will be deducted from the refund, in accordance with the Domain Price List. After this period, Registros.com reserves the right to grant a full or partial refund at its sole discretion.

e. The Client acknowledges that the registration, renewal, transfer, or restoration of a domain requires the payment of mandatory fees, and therefore, payments made for such services are strictly non-refundable. This includes, but is not limited to:

  • Typographical errors when registering a domain.
  • Domain cancellation due to a violation of this Agreement.
  • Domain revocation or transfer to a third party as a result of a dispute.
  • Voluntary transfer of the domain by the Client to another provider.

f. Notwithstanding the above, Registros.com will refund any payment related to a domain registration request that cannot be processed as specified in Section 4.2.1(b) and the Domain Registration Agreement.

g. Refunds will be processed within a maximum of thirty-one (31) days from the date of the refund request, and will be issued using the original payment method whenever possible. If a refund cannot be processed via the original payment method, Registros.com may, at its discretion, issue the refund via account credit.

h. The Client is not entitled to any refund if their Account and/or Services are canceled due to a violation of this Agreement or any referenced Policies and Agreements.

i. Registros.com reserves the right to cancel and refund any payment if there is a reasonable suspicion that the payment was made using fraudulent means. If a payment dispute or chargeback is initiated by the Client, Registros.com reserves the right to immediately suspend or terminate all associated Services until the matter is resolved. Any fees incurred due to chargebacks or payment reversals will be the responsibility of the Client. In such cases, Registros.com will cancel the corresponding order and will not be obligated to provide the requested Service.

4.6 List of Providers and Applicable Terms and Conditions

a. The Client acknowledges and agrees that Registros.com is itself subject to the Terms and Conditions of its Providers and other entities responsible for administering and/or regulating the Services offered through its platform. Consequently, the Client accepts all Service Agreements and Terms and Conditions associated with the purchase and/or use of these Services.

Furthermore, the Client acknowledges that Registros.com is not responsible for any modifications, limitations, or service conditions imposed by Providers. Registros.com has no control over changes made to Provider Agreements and is not liable for any service disruptions, price modifications, or policy updates enacted by the Provider. Continued use of the Services constitutes acceptance of any updates to the Provider’s Terms and Conditions.

b. The Client expressly agrees, without limitations, to the following Agreements and Terms and Conditions that apply to their Services:

Domain Registration Services

Business Email and SSL Certificate Services

The Client acknowledges that failure to comply with the applicable Provider’s Terms and Conditions may result in service suspension or termination without prior notice, as required by the Provider.

c. In the event of a conflict between this Agreement and the Terms and Conditions of the Providers specified in Section 4.6 (b), the Provider’s Terms shall prevail for the respective Service.

5. Service Availability

a. Registros.com will take all reasonable measures to maintain continuous access to its systems, Services, and any stored data. This includes implementing appropriate security measures, maintaining regular backups, and using redundant systems within its infrastructure. However, the Client acknowledges that Registros.com cannot guarantee absolute availability of its systems and Services at all times. As a result, the Client accepts that access to the Registros.com website, User Account, and associated Services may be partially or fully interrupted.

Accordingly, Registros.com disclaims any liability for damages resulting from such interruptions, including, but not limited to, loss of revenue incurred by the Client. Registros.com shall not be liable for Service interruptions caused by force majeure events, including, but not limited to, natural disasters, cyberattacks, government actions, third-party provider failures, or any event beyond Registros.com’s reasonable control.

If a Service interruption exceeds six (6) hours, Registros.com may, at its sole discretion, offer a partial refund of the Client’s most recent payment for the affected Service, proportionate to the duration of the outage. The refund will be calculated based on the percentage of downtime relative to the total contracted period specified in the Client’s last invoice, and this percentage will be applied to the amount paid in that invoice. The maximum refund amount shall not exceed the total amount paid for the affected Service in the most recent billing period.

b. Registros.com will make every reasonable effort to keep its web server and any software used in its website and/or Client Services up to date. However, Registros.com reserves the right to withhold or delay the installation of updates or patches that may negatively impact the Service’s performance or stability. The Client acknowledges that Registros.com shall not be liable for any compatibility issues, security risks, or performance limitations resulting from updates that are postponed or not installed for stability reasons.

c. Registros.com relies on its Providers to ensure the continuity and stability of its Services. Consequently, Registros.com will take all commercially reasonable measures to maintain and/or restore proper Service functionality whenever necessary. The Client acknowledges that Registros.com’s ability to maintain service availability depends on third-party Providers. Registros.com shall not be held liable for outages, degradation, or delays caused by such third-party providers.

6. Content

a. Registros.com has no obligation to review, monitor, or control any content received, referenced, transmitted, or stored by the Client through the contracted Services. The Client expressly declares that:

  • (i) they have the necessary rights to distribute, publish, and/or store any content through the Registros.com website or any of its Services,
  • (ii) such content does not infringe upon the rights of any third party, and
  • (iii) such content does not violate any applicable laws or regulations.

b. The Client is solely responsible for any content published, referenced, transmitted, or stored through the contracted Services. Registros.com disclaims any liability for such content. The Client agrees to defend (using legal counsel of Registros.com’s choice), indemnify, and hold Registros.com harmless from any claims, damages, regulatory fines, penalties, attorney fees, court-ordered damages, settlements, and any other liabilities arising from content hosted through the Services. The Client shall bear all related legal costs, including pre-litigation expenses.

c. The Client warrants that they own the necessary rights to distribute, publish, or store any content and guarantees that such content does not infringe upon third-party rights or violate any applicable laws or regulations. If the Client misrepresents ownership or authorization of any content, Registros.com reserves the right to suspend or terminate the affected Services immediately, without refund.

d. Registros.com reserves the right to use content from Client reviews and ratings published on the "Trustpilot" platform for promotional purposes. The Client expressly agrees to the publication and/or use of their reviews and ratings related to Registros.com Services, as well as their personal data, in accordance with the conditions set forth in the Registros.com Privacy Policy.

Registros.com may reproduce, display, modify for formatting purposes, and publicly distribute Client reviews for promotional use. However, Registros.com shall not alter the content in a way that changes the intent or meaning of the review.

The Client may request the removal or deletion of their reviews and/or ratings published through Registros.com at any time by sending a request to legal[@]registros.com.

7. Security

a. The Client understands and agrees that they are solely responsible for maintaining the confidentiality of their Registros.com User Account login credentials (including username and password) and any other critical account-related information (such as credit card details).

b. Registros.com will decline any request to modify a password unless it is accompanied by written authorization from the Client, along with a valid identification document for identity verification purposes.

c. The Client agrees to implement the security best practices recommended by Registros.com in its Privacy Policy or other official communications. To ensure the security of their Account and Services (including, but not limited to, Hosting accounts and email services). The Client must securely store their login credentials and take necessary precautions to prevent unauthorized access.

d. The Client acknowledges and accepts full responsibility for all activities conducted through their Account and/or linked Services. The Client agrees to notify Registros.com of any unauthorized access or security breach involving their Account within twenty-four (24) hours of detection.

e. Registros.com disclaims all liability for any losses incurred by the Client due to unauthorized access by a third party to their User Account, whether or not such access was authorized by the Client. Registros.com is not obligated to investigate or recover stolen accounts or data lost due to unauthorized access. The Client assumes full responsibility for any damage caused by compromised credentials, including but not limited to data loss, service disruption, and reputational harm.

f. The Client is responsible for ensuring that all software and/or code hosted within their Account is secure, properly configured, and free from malicious software. Registros.com disclaims all liability for any damage caused to the Client or any third party due to the Client’s failure to maintain security. The Client agrees to defend (using legal counsel of Registros.com’s choice), indemnify, and hold Registros.com harmless from all claims, damages, or liabilities arising from software or code hosted within the Client’s Services. Registros.com reserves the right to suspend or terminate any Service found to contain malicious software or improperly configured security settings, without prior notice, to prevent harm to its infrastructure or other Clients.

g. The Client agrees to grant Registros.com permission to access their Account, content, and files stored within their Account and/or Services for the purposes of:

  • Resolving technical issues and providing customer support.
  • Verifying compliance with the terms of this Agreement.
Additionally, Registros.com will conduct periodic automated security scans of the Client’s Services to ensure their security. Registros.com reserves the right to modify file permissions, quarantine, or remove any files that contain malicious code or fraudulent intent. Registros.com will make reasonable efforts to notify the Client when security-related modifications are made, except in cases where immediate action is required to prevent harm to its infrastructure.

8. Notifications and Notices

a. The Client understands and agrees that all Notices related to this Agreement (except for notices concerning violations or termination of the Agreement, which may be sent via email or postal mail) may be:

  • Published on the Registros.com website, or
  • Sent via email to the email address specified by the Client in their User Account.
A notice shall be deemed delivered on the earlier of:
  • (i) The date it is published on the Registros.com website, or
  • (ii) The date it is sent to the email address associated with the Client’s User Account.
The Client acknowledges and agrees that it is their responsibility to regularly review notifications published on the Registros.com website or sent via email.

b. The Client is responsible for ensuring that the email address associated with their User Account remains valid and functional at all times. Additionally, the Client is responsible for ensuring that notifications from Registros.com are properly received by their email server and/or email service provider. The Client must take all necessary measures to prevent Registros.com’s notifications from being blocked or marked as spam (SPAM).

Registros.com shall not be responsible for any consequences arising from the Client’s failure to maintain a valid and functional email address, including, but not limited to, missed renewal notices, service interruptions, or legal notifications.

If the Client’s registered email address becomes inactive or inaccessible, the Client remains responsible for updating their contact details in their User Account. Registros.com shall not be liable for any failure to deliver notices due to an outdated or non-functional email address.

The failure to receive a notice or notification due to non-compliance with this clause shall not exempt the Client from any obligations arising from such notification. Additionally, it shall not be considered a failure by Registros.com to fulfill its notification obligations in cases where such obligations apply.

The Client acknowledges that Registros.com shall not be liable for any consequences resulting from the failure to receive notifications due to:

  • Issues with the Client’s provided email address, or
  • Misconfigurations in the Client’s email server or email filtering settings.

9. Customer Support Service

a. Registros.com provides complimentary assistance to its Clients exclusively for questions and issues directly related to the contracted Services. Registros.com reserves the right to determine which questions and/or issues fall within the scope of its support services and may decline assistance or charge additional fees for inquiries or issues unrelated to the contracted Services.

Registros.com reserves the right to offer premium or chargeable support for assistance that extends beyond the standard scope of Services, including but not limited to, advanced troubleshooting, custom configurations, or third-party software issues.

b. Registros.com exclusively provides support through its Ticket System, available under the "Sumbit Ticket" and "Support" sections within the Client’s User Account. This system allows Registros.com to review, prioritize, and properly investigate inquiries and/or incidents, ensuring the most effective and timely resolution based on their importance.

Registros.com will make reasonable efforts to respond to inquiries in a timely manner. However, Registros.com does not guarantee specific response or resolution times and reserves the right to prioritize inquiries based on urgency and impact on Services.

c. Registros.com will not issue refunds for tasks or assistance provided by its employees in response to inquiries that are unrelated to the Client’s contracted Services.

d. Registros.com reserves the right to verify the Client’s identity if it determines that processing a support request could compromise the security or operation of the Client’s Account and/or related Services.

e. The Client acknowledges and agrees that Registros.com can only provide the requested assistance if the Client provides all relevant and necessary information. Consequently, the Client agrees to furnish all required data and details to allow Registros.com to properly evaluate and process the support request.

f. The Client agrees to create and maintain up-to-date backups of all data, files, messages, hosting accounts, and any other relevant content before requesting support. Additionally, the Client accepts that Registros.com may need to perform interventions or operations on their Services to resolve the reported issue.

Registros.com shall not be liable for any loss or corruption of data, including, but not limited to:

  • Data loss resulting from actions taken by Registros.com to resolve a support request.
  • Hardware failures, software malfunctions, or other technological failures.
  • Data loss caused by Client actions, including but not limited to, misconfigurations, accidental deletions, or failure to follow backup procedures.

g. Registros.com es perfectamente consciente de que las incidencias y/o errores en el Servicio pueden resultar frustrantes para el Cliente. Por ese motivo, Registros.com se esfuerza por proporcionar una asistencia rápida, eficaz y cortés, y es parte de nuestra cultura comunicar en todo momento con respeto y profesionalidad. De la misma forma, con el objetivo de preservar la dignidad de nuestras/os empleadas/os, requerimos de nuestros Clientes que las comunicaciones se lleven a cabo en todo momento mostrando el debido respeto. Registros.com se reserva el derecho de denegar asistencia y/o no renovar los Servicios de aquellos Clientes que vulneren la dignidad de nuestros empleados utilizando lenguaje ofensivo y/o abusivo, amenazas, comentarios discriminatorios, demandas irrazonables repetidas o cualquier otro comportamiento que interrumpa la capacidad del personal de Registros.com para proporcionar soporte de manera efectiva. En el caso de no renovación de los Servicios, Registros.com podrá poner a disposición del Cliente la información necesaria para transferir sus Servicios a otro proveedor, sin que ello le otorgue derecho a reembolso ni compensación de ningún tipo.

10. Intellectual Property

a. All content, including but not limited to texts, logos, trademarks, images, and software owned by Registros.com, is the exclusive property of Registros.com and is protected under Intellectual Property laws and other applicable legal provisions.

Any exploitation, reproduction, distribution, modification, or unauthorized use of such content without the express written authorization of Registros.com is strictly prohibited.

b. Registros.com reserves the right to take legal action against any unauthorized use or infringement of its intellectual property. Such actions may include, but are not limited to:

  • Immediate suspension or termination of the infringing Client’s account and Services.
  • Cease and desist notices requiring the immediate removal of infringing materials.
  • Legal claims for damages and compensation arising from the unauthorized use of Registros.com’s intellectual property.

c. The Client acknowledges that any unauthorized use of Registros.com’s intellectual property may result in financial and legal consequences, including potential liability for damages, legal fees, and court costs.

11. Privacy

a. The Registros.com Privacy Policy is available at the following link: Privacy Policy , and is incorporated into this Agreement by reference.

11.1 Disclosure of Data to Law Enforcement

a. Registros.com reserves the right to disclose information, including data the Client may consider confidential, in order to:

  • Comply with a court order, subpoena, disclosure request, regulation, or government request.
  • Protect Registros.com, its employees, agents, owners, partners, or any other related parties from harm.
  • Prevent fraud, abuse, or security threats, including cooperation with third-party security firms, fraud prevention agencies, or payment processors.
Registros.com may disclose such information without prior notice to the Client unless legally required to do otherwise.

b. Cooperation with third-party attorneys or legal representatives in relation to civil claims or legal proceedings shall be at Registros.com’s sole discretion.

  • Responses to document production requests or any other legal matters requiring significant effort from Registros.com will incur a fee of $200 per hour.
  • Registros.com reserves the right to refuse or limit legal assistance requests that it deems excessive, unreasonable, or outside the scope of its operational capabilities.
  • Registros.com reserves the right to require a deposit in advance to ensure payment for these services. Deposits for legal assistance are non-refundable once work has commenced.

12. Modification of Terms and Conditions

a. Registros.com will notify the Client of any modifications to the Terms and Conditions via email at least fifteen (15) days prior to the changes taking effect.

b. If the Client does not agree with the modifications, they shall have the right to cancel this Agreement and terminate the contracted Services directly through Registros.com. However, such termination shall not entitle the Client to a refund for any previously contracted Products and Services.

c. Continued use of the Services after the modification date shall constitute acceptance of the new Terms and Conditions.

13. Limitation of Liability

a. Registros.com shall not be liable to the Client for any damages, losses, or harm arising in connection with this Agreement or the Services provided, except in cases of gross negligence or willful misconduct by Registros.com. This limitation of liability includes, but is not limited to:

  • (i) Loss of data.
  • (ii) Direct or indirect damages.
  • (iii) Special, exemplary, consequential, incidental, or punitive damages.
  • (iv) Loss of profits, revenue, business opportunities, or search engine rankings.
  • (v) Loss of business reputation, goodwill, anticipated savings, or other intangible losses.

Registros.com shall not be liable for damages, losses, or disruptions caused by third-party providers, including but not limited to hosting services, domain registrars, payment processors, or software vendors.

The Client acknowledges and agrees that Registros.com’s liability is strictly limited to cases of gross negligence or willful misconduct, and any damage or loss not meeting these conditions shall not be attributable to Registros.com. This limitation of liability applies to the maximum extent permitted by applicable law.

b. The Client understands and agrees that any claim or cause of action related to the website or Services must be filed within one (1) year from the event giving rise to such claim. Otherwise, the claim shall be deemed invalid and unenforceable.This limitation applies to each individual claim, and claims may not be aggregated to extend the statute of limitations.

c. In no event shall Registros.com’s total liability, regardless of the form of action, exceed the total amount paid by the Client for the disputed Service or Product during the twelve (12) months preceding the event that gave rise to the dispute.

d. If the applicable laws of a particular state or jurisdiction do not allow a liability exclusion as broad as stated above, a limitation of liability shall apply to the maximum extent permitted by law. This limitation shall remain valid even after the termination or expiration of this Agreement or the use of the website or Services.

14. Indemnity

a. The Client agrees to indemnify, defend, and hold Registros.com harmless from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising from:

  • (i) The Client’s use of the Services and Products.
  • (ii) The Client’s violation of this Agreement or any applicable laws and regulations.
  • (iii) Any claims by third parties alleging that content hosted, transmitted, or distributed by the Client through Registros.com’s Services infringes upon intellectual property rights, privacy rights, or other legal protections.

b. The Client’s obligation to indemnify shall remain in effect even after the termination or expiration of this Agreement.

15. Entire Agreement

a. The parties make no warranties or representations other than those expressly stated in this Agreement. Any oral or other agreements not expressly included in this Agreement shall be considered invalid and unenforceable.

Any modifications or amendments to this Agreement must be made in writing and explicitly agreed upon by both parties.

b. The Client understands and agrees that this Agreement, including the policies incorporated by reference (e.g.,Privacy Policy«, «Domain Registration Agreement«, «Acceptable Use Policy, constitutes a single and binding Agreement governing the use of Registros.com’s Services and Products.

In the event of a conflict between this Agreement and any referenced policy, the terms of this Agreement shall prevail unless explicitly stated otherwise.

16. Severability Clause

a. If any provision of this Agreement is found to be unenforceable or invalid under applicable law or due to a court ruling, the validity of the remaining provisions shall remain unaffected and in full force.In such a case, the invalid provision shall be replaced with a valid and enforceable provision that closely reflects the original intent and purpose to the maximum extent permitted by law.Only the minimum necessary modification shall be applied to render the provision enforceable, without altering the overall intent or balance of this Agreement.

17. Force Majeure

a. Registros.com will make all reasonable efforts to keep its website and Services operational. However, the Client acknowledges that technical difficulties and other factors beyond Registros.com’s control may result in temporary service interruptions.

b. Neither party shall be liable for failure or delay in the performance of any of its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to:

  • Fires, floods, earthquakes, or other natural disasters.
  • Labor disputes, strikes, or industrial actions.
  • Accidents, acts of war, terrorism, or civil disturbances.
  • Disruptions in transportation, communication networks, or utility services.
  • Shortages of supplies, materials, or essential equipment.
  • Failures by third parties to fulfill commitments necessary for the performance of obligations under this Agreement.

c. If a force majeure event substantially prevents or delays performance for a period exceeding thirty (30) consecutive days, either party may terminate the affected Service(s) without penalty. However, this shall not entitle the Client to a refund for Services already rendered or paid for prior to termination.

18. Representations and Warranties

18.1 Service Warranties by Registros.com

a. Registros.com warrants that it will provide the Services in accordance with industry standards. If the Client wishes to file a claim for a breach of these service warranties, they must contact Registros.com in writing and provide reasonably detailed information regarding the alleged breach within thirty (30) days from the date of the alleged non-compliance.

In such a case, the Client’s sole and exclusive remedy—and Registros.com’s only obligation—shall be, at Registros.com’s sole discretion:

  • (i) Reperformance of the affected Service(s), or
  • (ii) Issuance of a service credit based on the duration of the non-compliant Service.

Service credits, if granted, will be calculated based on the pro-rata portion of the affected Service’s downtime relative to the total billing period. Service credits are non-refundable and may only be applied toward future invoices. Service credits shall not exceed the total fees paid for the affected Service during the applicable billing cycle.

THIS WARRANTY EXPRESSLY EXCLUDES SERVICES PROVIDED BY THIRD PARTIES.

EXCEPT AS EXPRESSLY PROVIDED IN THIS AGREEMENT, REGISTROS.COM DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

18.2 Representations and Warranties by the Client

a. The Client agrees to reasonably cooperate with Registros.com to facilitate the use of the Services. Such cooperation includes, but is not limited to:

  • Providing accurate and up-to-date contact and billing information.
  • Ensuring that the Client, its employees, or agents possess the necessary technical knowledge to implement and manage the contracted Services.

b. The Client is solely responsible for ensuring their ability to connect with Registros.com to use the Services. The Client represents and warrants that they, or the entity they represent, have the necessary technical knowledge and expertise to use the Services.

c. The Client and/or their authorized representatives warrant that the Client is at least 18 years of age and possesses the legal authority to enter into this contractual relationship.

d. The Client represents and warrants that neither they nor their company have been designated as a «Specially Designated National» or «Blocked Person» by the United States Department of the Treasury, Office of Foreign Assets Control (OFAC).

19. Disclaimer of Liability

a. EXCEPT FOR THE WARRANTY PROVIDED IN SECTION 18.1, THE SERVICES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE (EVEN IF SUCH PURPOSE IS KNOWN TO REGISTROS.COM), OR ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

UNDER NO CIRCUMSTANCES SHALL ANY ORAL OR WRITTEN INFORMATION OR ADVICE PROVIDED BY REGISTROS.COM, ITS EMPLOYEES, AGENTS, OWNERS, DIRECTORS, OFFICERS, OR AFFILIATES CREATE A REPRESENTATION OR WARRANTY OR IN ANY WAY EXPAND THE SCOPE OF REPRESENTATIONS AND WARRANTIES SET FORTH IN THIS AGREEMENT.

REGISTROS.COM MAKES NO REPRESENTATIONS OR WARRANTIES THAT THE SERVICES WILL BE COMPLETE, FREE FROM DEFECTS, OR ERROR-FREE.

REGISTROS.COM DOES NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. REGISTROS.COM SHALL NOT BE LIABLE FOR ANY INTERRUPTIONS, DELAYS, OR FAILURES CAUSED BY FACTORS BEYOND ITS REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO NETWORK FAILURES, INFRASTRUCTURE ISSUES, OR ACTS OF THIRD PARTIES.

REGISTROS.COM SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR SECURITY BREACHES CAUSED BY THIRD PARTIES, INCLUDING BUT NOT LIMITED TO HACKING ATTEMPTS, MALICIOUS SOFTWARE, OR UNAUTHORIZED ACCESS TO CLIENT DATA.

b. Registros.com shall not be liable for any data loss caused by events beyond its reasonable control, including but not limited to unauthorized access or data corruption. The Client is solely responsible for maintaining adequate backups of their data.

REGISTROS.COM SHALL NOT BE LIABLE FOR ANY LEGAL OR REGULATORY CONSEQUENCES ARISING FROM DATA LOSS, INCLUDING BUT NOT LIMITED TO FINES, PENALTIES, OR SANCTIONS IMPOSED UNDER PRIVACY LAWS.

c. Registros.com is not responsible for, and expressly disclaims any liability for, unauthorized access by third parties or data breaches resulting from the Client's failure to keep their software, web applications, including any modules or plugins, up to date.

THE CLIENT IS SOLELY RESPONSIBLE FOR IMPLEMENTING AND MAINTAINING SECURITY MEASURES TO PROTECT THEIR DATA, INCLUDING BUT NOT LIMITED TO STRONG PASSWORDS, FIREWALLS, ENCRYPTION, AND REGULAR SOFTWARE UPDATES.

20. Independence of the Parties

a. Registros.com and the Client acknowledge and agree that they are independent entities. Nothing in this Agreement shall be construed as creating an agency, partnership, joint venture, or any other form of legal association between the parties.

b. Neither party shall have the authority to bind or obligate the other party in any manner, nor shall either party represent to any third party that such authority exists.

21. Jurisdiction

a. Governing Law: This Agreement, along with all referenced Policies and Agreements, shall be governed by and interpreted in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles.

b. Dispute Resolution Venue: Any dispute, controversy, or claim arising out of or relating to this Agreement, including but not limited to its existence, validity, interpretation, performance, breach, or termination, shall be exclusively resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association ("AAA").

  • The arbitration shall take place in Kent County, Delaware, and shall be conducted in English.
  • The arbitrator shall have the authority to issue a final award and grant injunctive relief under the laws of the State of Delaware.
  • Any court of competent jurisdiction may enforce the arbitration award.
  • The parties agree that arbitration shall be the exclusive means of resolving disputes, and neither party shall initiate or participate in any lawsuit, except to enforce an arbitration award or seek injunctive relief.
  • The arbitrator shall have no authority to award punitive, consequential, or exemplary damages, except where expressly permitted by applicable law.

c. Waiver of Jury Trial: The Client and Registros.com expressly waive their right to a jury trial in any legal action or proceeding related to or arising from this Agreement.

22. No Third-Party Rights

a. This Agreement does not confer any rights or benefits to third parties who are not a party to this contract. No individual or entity other than the Client and Registros.com shall have any right to enforce any terms of this Agreement.
